Terms of Service

1. Acceptance of Terms
By accessing or using CourseOS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes are posted constitutes acceptance.
2. Description of Service
CourseOS is an AI-powered platform that allows creators ("Creators") to build and sell online courses, and learners ("Students") to enrol in and complete those courses. We provide tools including an AI course builder, a hosted school site, secure checkout, quizzes, certificates, and related features.
3. Accounts
- You must be at least 13 years old to use the Service.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate and complete information when registering.
- You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.
- We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. Creator Responsibilities
If you use the Service as a Creator you agree that:
- You own or have all necessary rights to the content you upload and sell.
- Your content does not infringe any third-party intellectual property rights, violate any laws, or contain harmful, misleading, or illegal material.
- You are solely responsible for the accuracy of your course content and for delivering what you advertise to Students.
- You are responsible for setting appropriate pricing, managing your Stripe account, and complying with applicable tax obligations in your jurisdiction.
- You grant CourseOS a limited, non-exclusive licence to host, display, and deliver your content to enrolled Students for the purpose of operating the Service.
5. Student Responsibilities
If you use the Service as a Student you agree that:
- Course content is for your personal, non-commercial use only.
- You will not reproduce, distribute, or resell course materials without the Creator's permission.
- Enrolment grants you access to the specific course purchased; it does not transfer ownership.
6. Payments and Refunds
- Payments are processed by Stripe. By making a purchase you agree to Stripe's terms of service.
- Refund policies for individual courses are set by the Creator. CourseOS is not responsible for refunds on Creator-sold courses unless required by applicable law.
- Platform subscription fees (Pro, Business plans) are non-refundable except where required by law or as explicitly stated at the time of purchase.
7. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations.
- Post or transmit content that is unlawful, harmful, threatening, abusive, or defamatory.
- Infringe the intellectual property rights of others.
- Use the Service to send spam or unsolicited communications.
- Attempt to gain unauthorised access to any part of the Service or its related systems or networks.
- Use automated tools (bots, scrapers) to access or extract data from the Service without our written consent.
- Interfere with or disrupt the integrity or performance of the Service.
8. Intellectual Property
CourseOS and its licensors own all rights, title, and interest in the platform, including its software, design, and branding. Nothing in these Terms transfers ownership of platform IP to you. Creator content remains the property of the Creator. Student-submitted content (e.g. discussion posts) remains the property of the Student.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Course content is provided by independent Creators; we do not endorse or verify its accuracy.
10. Limitation of Liability
To the fullest extent permitted by law, CourseOS and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) $100 USD.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 8, 9, 10, and 12) will survive.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms will be resolved through binding arbitration or in courts of competent jurisdiction, depending on the applicable law in your region.
